A Linesville-area man who is serving consecutive sentences for first-degree murder charges in the shooting deaths of a man and his wife, has filed a motion seeking a new trial in a case in which he was accused of robbing a drug store.

41 year-old Gary Wiley is imprisoned for the deaths of 51 year-old Tod Prenatt and his 44 year-old wife Laurie Prenatt at the couple’s home outside Linesville in April, 2010.  He was also convicted of stealing cash and prescription drugs from a Linesville pharmacy just days before the shootings.

Wiley claims a witness who could have provided him an alibi in the robbery trial was never called to testify.  His conviction on the robbery-related charges resulted in a prison term of up to ten years.
